1. Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you and LOOY UG (haftungsbeschränkt), a limited liability company registered in Germany ("PayBaan", "we", "us", or "our"). By accessing or using PayBaan's services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our services.

2. About PayBaan

PayBaan is a mobile top-up service that allows users to send prepaid airtime to mobile phones in 170+ countries through our partnerships with mobile network operators worldwide. The maximum single top-up amount is €31, with daily and monthly limits in place per account.

We are not a regulated payment institution and do not require an e-money or payment institution license under PSD2 or the German Payment Services Supervision Act (ZAG). Payment processing is handled by Stripe Payments Europe Ltd, a fully licensed PSD2 institution, and funds move directly from your payment method to our mobile operator partners.

You may use PayBaan as a guest for limited top-up amounts, or create an account to access higher limits and saved recipients. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials.

6. Refunds

Failed top-ups are automatically refunded to your original payment method. Successful top-ups cannot be reversed, as the airtime has been delivered to the recipient. See our Refund Policy for details.

The PayBaan name, logo, design, and all related materials are the exclusive property of LOOY UG. You may not use them without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by German law, PayBaan's liability is limited to the amount of the relevant transaction. We are not liable for indirect, consequential, or punitive damages.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms or the use of our services shall be resolved in the courts of Frankfurt am Main, Germany.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
